1. Acceptance of Terms
These Website Terms & Conditions (“Terms”) govern access to and use of https://lashfoundation.org, including related pages, forms, online services, the charity auction, and merchandise store (collectively, the “Website”).
By accessing or using the Website, submitting a form, making a donation, placing an auction bid, or purchasing merchandise, the user agrees to these Terms and any terms specifically presented for a particular service or transaction. If a user does not agree to these Terms, the user should not use the applicable portion of the Website.
2. About the L.A.S.H. Foundation
Lending A Supporting Hand Foundation, also known as the L.A.S.H. Foundation (“L.A.S.H.,” “Foundation,” “we,” “us,” or “our”), is a 501(c)(3) nonprofit organization recognized by the Internal Revenue Service under EIN 92-2857641.
The Foundation serves communities in Nevada and Maryland through programs that may include legal support and documentation assistance, reintegration support, family stabilization services, workforce readiness and job placement, youth mentorship, the LASH Haven emergency shelter when available, and LASH HomeKeepers housing counseling and loan-modification assistance for eligible homeowners.
Program availability, eligibility, locations, hours, and services may change based on funding, staffing, capacity, partnerships, and community needs.
3. Not Legal Advice; Program Disclaimers
L.A.S.H. Foundation is not a law firm and does not provide legal advice. The Website and Foundation programs may provide general information, documentation assistance, legal navigation, referrals, or other supportive services. When legal advice is needed, the Foundation may refer individuals to licensed attorneys or legal-aid organizations.
LASH HomeKeepers housing counseling and loan-modification assistance are not legal, tax, or financial advice. The Foundation does not guarantee that a lender, servicer, investor, or other party will modify, refinance, forgive, defer, or otherwise change a loan.
The Foundation’s programs are not affiliated with or operated by any government agency, lender, mortgage servicer, or other financial institution unless expressly stated on the applicable page.
4. Acceptable Use
The Website may be used only for lawful purposes and in accordance with these Terms. Users must not:
- Use the Website for unlawful, fraudulent, threatening, abusive, discriminatory, defamatory, harassing, or harmful activity;
- Impersonate another person or organization or falsely claim an affiliation with the Foundation;
- Upload, transmit, introduce, or distribute malware, viruses, ransomware, malicious code, or other harmful material;
- Attempt to gain unauthorized access to the Website, accounts, systems, forms, portals, or data;
- Scrape, crawl, harvest, copy, download, or systematically collect Website content or personal information without written permission;
- Interfere with the Website’s operation, security, availability, or other users’ access;
- Submit information that is knowingly false, misleading, incomplete, or intended to interfere with program administration;
- Use automated tools or methods to place orders, submit bids, send requests, or otherwise abuse Website features; or
- Violate any applicable law, regulation, court order, or third-party right.
The Foundation may investigate suspected misuse and may suspend, restrict, or terminate access to the Website or any related feature when reasonably necessary to protect users, the Foundation, its service providers, or the public.
5. Applications and Submissions
The Website may include help applications, volunteer forms, contact forms, donation forms, event registrations, and other submission tools.
Applicants and volunteers are expected to meet the eligibility requirements stated for the applicable program or opportunity and to provide accurate, current, and complete information. The Foundation may request additional information, verify submitted information, or decline, defer, or close an application when eligibility, capacity, safety, documentation, or program requirements are not satisfied.
Submitting a help application, volunteer form, or other request does not create a client, attorney-client, fiduciary, employment, agency, or other professional relationship with the Foundation. Submission does not guarantee acceptance, eligibility, funding, placement, services, or any particular result.
The Foundation may use submitted information to review requests, communicate with applicants, administer programs, comply with legal and funding obligations, and for other purposes described in the Privacy Policy.
6. Donations
L.A.S.H. Foundation is a 501(c)(3) nonprofit organization with EIN 92-2857641. Donations are voluntary and are processed through Stripe or another applicable payment processor identified during the transaction.
Donations are generally non-refundable unless a refund is required by law or approved by the Foundation. Refund requests are handled case by case. Recurring donations may be canceled at any time by contacting the Foundation or using an available cancellation method provided by the payment processor.
The Foundation provides a donation acknowledgment or receipt for qualifying gifts. Contributions are tax-deductible only to the extent allowed by applicable law. The Foundation does not determine a donor’s tax treatment or the deductible value of a contribution.
The Foundation may use unrestricted donations for the programs, operations, and community needs it determines to be most appropriate. If a stated fundraising purpose is fully funded, unavailable, or cannot lawfully be carried out, the Foundation may redirect funds to a substantially related charitable purpose or another area of greatest need.
The Foundation does not accept gifts subject to conditions, restrictions, or requirements that it cannot lawfully meet or responsibly administer.
7. Charity Auction
The Foundation may operate a live or online charity auction at https://lashfoundation.org/auction. The auction listing for each item is part of the applicable transaction terms.
7.1 Item Condition
Unless the applicable listing states otherwise, auction items are sold “as is” and “where is,” without warranties regarding condition, quality, merchantability, fitness for a particular purpose, or future performance. Bidders are responsible for reviewing the listing and any available descriptions, photographs, measurements, and other information before bidding.
7.2 Bids and Acceptance
Each bid is a binding offer to purchase the item at the bid amount if the bid is accepted under the auction process. Bids may not be withdrawn except where permitted by the applicable listing or required by law. The Foundation may reject, cancel, correct, or invalidate a bid affected by error, technical malfunction, fraud, suspected abuse, or other circumstances permitted by law.
7.3 Payment and Pickup
Payment in full is required before pickup. No buyer’s premium is charged unless the applicable auction listing expressly states otherwise; any listing that does not state a buyer’s premium has none.
The applicable auction listing will state the pickup window and pickup location in Las Vegas. Buyers are responsible for collecting items during the stated window and for providing appropriate transportation and assistance.
Risk of loss passes to the buyer when the item is released to the buyer or the buyer’s authorized representative at pickup.
7.4 Shipping
If shipping is offered, it is at the buyer’s expense and risk. Shipping availability, charges, timing, packaging, and carrier arrangements will be stated in the applicable listing or communicated before shipment. The Foundation is not responsible for carrier delay, loss, damage, or delivery issues after shipment except to the extent required by law.
7.5 Nonpayment or Noncollection
If a buyer does not pay in full or does not collect an item within the applicable pickup window, the Foundation may cancel the transaction, withhold release of the item, treat the item as abandoned where permitted by law, relist or otherwise dispose of the item, and pursue any other lawful remedy. Any refund or credit will be handled according to the circumstances and applicable law.
7.6 Charitable Treatment of Auction Payments
Amounts paid above an item’s fair market value may be treated as a charitable contribution only to the extent permitted by applicable law. The Foundation may provide an acknowledgment when appropriate, but does not determine the tax treatment of any auction payment.
7.7 Cancellation or Rescheduling
The Foundation may cancel, postpone, or reschedule an auction or an individual listing because of technical issues, safety concerns, insufficient information, operational needs, weather, force majeure, suspected fraud, or other circumstances. The Foundation will provide notice when reasonably practicable.
8. Merchandise
The Foundation may offer merchandise at https://lashfoundation.org/merch. Proceeds from merchandise sales support the Foundation’s charitable programs and operations.
8.1 Orders and Acceptance
An order submission is an offer to purchase. An order is not accepted until the Foundation or its payment and fulfillment provider confirms acceptance or ships the order. The Foundation may decline, limit, or cancel an order because of availability, pricing or listing errors, suspected fraud, payment problems, shipping limitations, or other legitimate operational reasons. If payment has been received for a canceled order, the Foundation will process an appropriate refund.
8.2 Pricing and Availability
Prices, product descriptions, sizes, colors, quantities, and availability may change without notice. The Foundation may correct typographical, pricing, inventory, or product-description errors. Taxes and shipping charges, if applicable, will be presented during checkout or otherwise communicated before purchase.
8.3 Shipping and Delivery
Shipping methods, charges, and estimated delivery dates will be presented during checkout, on the applicable product page, or in the order confirmation. Delivery estimates are estimates and are not guaranteed. Delays may occur because of carrier issues, weather, supply limitations, holidays, or other circumstances outside the Foundation’s reasonable control.
8.4 Returns, Exchanges, and Defects
Returns or exchanges must be requested within the return or exchange window stated on the applicable product page, order confirmation, or other purchase materials. Products should generally be returned in the condition and packaging required by the applicable instructions.
A buyer who receives a damaged, defective, incorrect, or incomplete item should contact the Foundation promptly and provide the order information and a description or photograph of the issue. The Foundation will review the matter and, where appropriate, provide a replacement, exchange, repair, credit, or refund consistent with the product terms and applicable law.
9. User Content
Users may submit information, comments, photographs, testimonials, stories, feedback, or other content through the Website or Foundation programs.
Program participants retain their rights in their own stories and other original content. The Foundation will use participant stories, photographs, testimonials, or other donated content only with written permission, subject to the terms of that permission.
Users must have the right to submit any content they provide and must not submit content that infringes another person’s rights, violates the law, contains malicious code, or includes confidential information that the user is not authorized to disclose.
10. Intellectual Property
The Website and its content, including text, graphics, photographs, logos, designs, videos, audio, documents, software, and other materials, are owned by or licensed to the Foundation unless otherwise stated. They are protected by applicable intellectual-property laws.
Subject to these Terms, the Foundation grants a limited, revocable, nonexclusive permission to access and use Website content for personal, noncommercial, lawful purposes related to the Foundation’s services.
The L.A.S.H. Foundation name, trademarks, service marks, logos, and related branding may not be copied, modified, displayed, distributed, or used in a way that suggests sponsorship, affiliation, or endorsement without the Foundation’s prior written permission.
Nothing in these Terms transfers ownership of a participant’s story or other original content to the Foundation. Any permitted use of donated content is governed by the written permission provided for that content.
11. “As Is” Disclaimer
The Website, its content, and listed resources are provided on an “as is” and “as available” basis to the fullest extent permitted by law. The Foundation does not warrant that the Website will always be available, uninterrupted, secure, accurate, complete, current, or free from errors, viruses, or other harmful components.
The Foundation does not guarantee acceptance into a program, continued eligibility, funding, housing, employment, legal outcome, family outcome, reintegration outcome, loan modification, foreclosure alternative, debt relief, or any other specific result. A lender, servicer, investor, or other third party is not obligated to change the terms of a loan.
Resources, referrals, contact information, and opportunities listed on the Website are provided for convenience and may not be continuously verified for availability, accuracy, eligibility, or suitability. Availability may change without notice.
No information on the Website creates a warranty, promise, or guarantee that is not expressly stated in these Terms or in a separate written agreement signed by an authorized Foundation representative.
12. Third-Party Links and Referrals
The Website may contain links to third-party websites, payment processors, service providers, videos, forms, resources, or other content. The Foundation does not control and is not responsible for third-party content, privacy practices, security, availability, products, services, or terms.
Referrals to partner organizations, including housing providers and loan-modification partners, are provided for convenience and possible access to additional resources. The Foundation is not responsible for the services, decisions, representations, performance, or conduct of those organizations.
A link or referral does not constitute an endorsement, sponsorship, recommendation, or guarantee. Users should review the applicable third party’s terms and privacy practices before using its services or providing information.
13. Exclusion of Warranties
To the fullest extent permitted by law, the Foundation disclaims all express, implied, statutory, and other warranties relating to the Website, its content, its resources, its programs, its merchandise, its auction items, and third-party services, including warranties of merchantability, fitness for a particular purpose, title, noninfringement, accuracy, availability, security, and suitability.
Some jurisdictions do not allow the exclusion of certain warranties. In those jurisdictions, the exclusions apply only to the extent permitted by law.
14. Limitation of Liability
To the fullest extent permitted by law, L.A.S.H. Foundation and its directors, officers, employees, volunteers, agents, contractors, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, income, goodwill, opportunity, or anticipated savings, arising out of or related to the Website, programs, donations, auction transactions, merchandise, third-party services, or these Terms.
To the fullest extent permitted by law, the Foundation’s total liability arising out of or relating to the Website or these Terms will not exceed the amount paid to the Foundation by the claimant for the specific transaction giving rise to the claim, or, if no transaction is involved, the amount of one hundred dollars.
This limitation does not apply to liability that cannot lawfully be limited or excluded.
15. Indemnification
To the fullest extent permitted by law, a user agrees to defend, indemnify, and hold harmless L.A.S.H. Foundation and its directors, officers, employees, volunteers, agents, contractors, service providers, and affiliates from claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:
- The user’s breach of these Terms;
- The user’s unlawful or abusive use of the Website;
- The user’s submitted content;
- The user’s violation of another person’s rights; or
- The user’s violation of applicable law.
The Foundation may assume exclusive control of the defense of a matter subject to indemnification, and the user agrees to cooperate reasonably with that defense.
16. Dispute Resolution; Governing Law
The parties will first attempt in good faith to resolve any dispute concerning the Website, a transaction, a program, or these Terms through informal communication with the Foundation.
These Terms and any dispute arising from them are governed by the laws of the State of Nevada, without regard to conflict-of-law principles. If informal resolution is unsuccessful, claims must be brought in the state or federal courts located in Clark County, Nevada, unless the parties agree in writing to resolve a particular claim through arbitration.
These Terms do not create a mandatory arbitration requirement, and they do not include a class-action waiver. Nothing in these Terms waives any right to bring or participate in a class action or other collective proceeding where such a right cannot lawfully be waived.
17. Severability
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions will continue in effect.
18. Entire Agreement
These Terms, together with the Website Privacy Policy, Accessibility Statement, applicable transaction terms, and any written agreement expressly incorporated into a Foundation program or service, constitute the entire agreement concerning use of the Website and supersede prior Website terms on the same subject.
Additional terms presented for a specific donation, auction, merchandise order, program, event, or service will apply to that transaction or activity if they conflict with these Terms.
19. Assignment
A user may not assign or transfer rights or obligations under these Terms without the Foundation’s prior written consent. The Foundation may assign or transfer these Terms in connection with a reorganization, merger, transfer of assets, operational change, or other lawful transaction.
20. Waiver
The Foundation’s failure to enforce any provision of these Terms is not a waiver of its right to enforce that provision later. A waiver is effective only if provided in writing by an authorized Foundation representative.
21. Changes to These Terms
The Foundation may update these Terms from time to time. The revised version will be posted on the Website with a new effective date. The Foundation will provide notice of material changes through the Website or another reasonable method when appropriate.
The updated Terms apply prospectively from their stated effective date. Continued use of the Website after the effective date of revised Terms constitutes acceptance of the updated Terms to the extent permitted by law.
